My wife entered the US legally but her visa expired, so she was illegal for 2009. After we got married, we sent in her immigration paperwork, but she does not have an Alien Number or Social Security number. Is it still possible to include her on my taxes to file jointly? She had no income because of her status, so is it better to try to file jointly or should I file separately?

Tarox, This is a complex issue that you need to work through. Read Chapter 1 of IRS Pub 519, U.S. Tax Guide for Aliens. http://www.irs.gov/pub/irs-pdf/p519.pdf

Not sure if you can add her name considering she now does not have any legal status in the country. You need an immigration lawyer immediately to sort out her visa issue.
